1. Introduction

Welcome to Quercle. These Terms and Conditions govern your use of our web fetching and search API services.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Service Description

Quercle provides API services for:

• Web Fetch API: Fetching and extracting content from web pages with AI-powered analysis
• Web Search API: Searching the web and synthesizing answers with citations

3. Account Terms

To use our Service, you must:

• Create an account and provide accurate, complete information
• Be at least 18 years old or have parental consent
• Keep your API keys secure and confidential
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use

You may create multiple API keys for different applications. API keys can be revoked at any time through your dashboard.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws or regulations
• Collect personal information without consent
• Engage in any activity that could harm, disable, or impair our servers
• Attempt to gain unauthorized access to any systems
• Use the Service for spam, phishing, or malicious purposes
• Redistribute or resell the Service without authorization
• Circumvent rate limits or usage restrictions

We reserve the right to suspend or terminate accounts that violate these terms.

5. Payment Terms

Our Service operates on a prepaid credit system:

• Credits are purchased in advance
• Credits are valid for 6 months from the date of purchase
• 1 credit per Fetch API request
• 4 credits per Search API request
• All prices are displayed in USD and exclude applicable taxes
• Credits are non-transferable between accounts

We reserve the right to modify pricing at any time. Existing credit balances will not be affected by price changes.

6. Refund Policy

Refunds are available under the following conditions:

• The refund request must be submitted within 7 calendar days from the date of the first payment for the credits
• No more than 50 credits have been used from the purchased package
• Billing errors (duplicate charges or billing mistakes) will be fully refunded

Discretionary Refunds: Notwithstanding the above conditions, we reserve the right, at our sole discretion, to issue partial or full refunds based on the proportion of unused credits remaining in your account. Such discretionary refunds may be offered in cases where we deem it appropriate, including but not limited to service issues or customer goodwill. The decision to grant a discretionary refund and the amount are entirely at our discretion.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Quercle and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you process through our Service. We do not claim any intellectual property rights over the content you fetch or search results you generate.

8. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, accuracy of results, or that the Service will meet your specific requirements.

To the maximum extent permitted by law, Quercle and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of or inability to use the Service.

You use the Service at your own risk. You are solely responsible for any damage to your computer system or loss of data that results from your use of the Service.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may terminate your account at any time by contacting us. Upon termination:

• Your API keys will be immediately revoked
• Unused credits are non-refundable unless within the 7-day refund window and fewer than 50 credits have been used
• Your data may be retained for legal compliance purposes

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Israel.
